Terms of Service

Welcome to AiMedQs. These Terms of Service ("Terms") govern your access to and use of the AiMedQs website at aimedqs.com and all related services (collectively, the "Service"), operated by AiMedQs ("we," "us," or "our"). Please read these Terms carefully before using the Service.
1. Acceptance of Terms
By creating an account or using the Service in any way, you agree to be bound by these Terms, our Privacy Policy, and any additional terms or policies referenced herein. If you do not agree to these Terms, you must not access or use the Service.
We reserve the right to update these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
2. Account Registration
To use the Service, you must create an account. By registering, you represent and warrant that:
- You are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater.
- All information you provide during registration is accurate, current, and complete.
- You will maintain the accuracy of your account information and update it promptly if it changes.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- You will create and maintain only one account per person. Multiple accounts per individual are not permitted.
You must notify us immediately at [email protected] if you suspect any unauthorized access to or use of your account.
3. Subscription Plans and Credits
3.1 Credit-Based System
AiMedQs operates on a credit-based subscription model. Each practice scenario costs 50 credits. The following plans are available:
- Trial: 500 free credits with a 14-day trial period.
- Starter: 2,000 credits per month at $19 CAD/month.
- Pro: 5,000 credits per month at $39 CAD/month.
- Premium: 10,000 credits per month at $49 CAD/month.
All prices are in Canadian dollars and are subject to applicable taxes. Conditions apply to all offers and plans.
3.2 Auto-Renewal
All paid subscription plans automatically renew at the end of each billing cycle unless you cancel before the renewal date. You authorize us to charge your payment method on file for the applicable subscription fee at the start of each renewal period.
3.3 Credit Expiry
Credits are allocated at the beginning of each billing cycle. Unused credits do not roll over to the next billing cycle and expire at the end of the current billing period. There are no refunds or credits issued for unused credits.
3.4 Trial Terms
New users receive a one-time trial of 500 free credits, valid for 14 days from the date of account creation. Trial credits expire at the end of the 14-day period regardless of usage. Only one trial is permitted per person.
3.5 Pricing Changes
We reserve the right to change our subscription pricing at any time. If we change pricing, we will provide at least 30 days' advance notice via email to your registered email address. Price changes will take effect at the start of your next billing cycle following the notice period. If you do not agree with the new pricing, you may cancel your subscription before the price change takes effect.
3.6 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation:
- Your subscription will remain active until the end of the current billing cycle.
- You will retain access to all features of your plan until the end of the billing period.
- No further charges will be made after the current billing cycle.
- Any remaining credits will expire at the end of the current billing cycle.
4. Referral Program
AiMedQs offers a referral program under the following terms:
- Both the referring user ("Referrer") and the referred user ("Referee") receive 500 bonus credits upon the Referee's successful account creation and activation.
- Both the Referrer and Referee must have active accounts at the time of the referral for the bonus credits to be awarded.
- Referral credits are subject to the same expiry rules as regular subscription credits.
- Abuse of the referral program — including but not limited to creating fake accounts, self-referrals, or using automated tools to generate referrals — will result in forfeiture of referral credits and may lead to immediate account termination.
- We reserve the right to modify or discontinue the referral program at any time without prior notice.
Conditions apply. AiMedQs reserves the right to make the final determination on all referral-related disputes.
5. Intellectual Property
All content, materials, and technology associated with the Service are the exclusive property of AiMedQs and are protected by Canadian and international intellectual property laws. This includes, but is not limited to:
- All practice scenarios, exam questions, clinical cases, grading rubrics, model answers, and educational content.
- The proprietary question generation methodology, algorithms, adaptive learning systems, and automated grading processes.
- The design, layout, user interface (UI), user experience (UX) flow, visual elements, and overall look and feel of the platform.
- All software, source code, databases, and technical infrastructure.
- The AiMedQs name, logo, branding, trademarks, and trade dress.
- All textual content, documentation, graphics, and multimedia materials.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes only. This license does not include the right to:
- Copy, reproduce, distribute, republish, or create derivative works from any part of the Service or its content.
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or underlying methodology of the Service.
- Scrape, crawl, data mine, or use any automated means to extract content or data from the Service.
- Modify, adapt, translate, or create derivative works based on the Service or any part thereof.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
- Sublicense, sell, resell, transfer, or commercially exploit any aspect of the Service.
Any unauthorized use of our intellectual property constitutes a material breach of these Terms and may result in immediate account termination and legal action.
6. Acceptable Use
You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You shall not:
- Share your account credentials with any other person or allow others to access the Service through your account.
- Share, distribute, post, or publish any exam content, practice scenarios, questions, answers, or grading feedback from the Service in any form, on any platform, or through any medium.
- Use bots, scrapers, crawlers, or any other automated tools to access or interact with the Service.
- Attempt to circumvent any security features, access controls, or usage limitations of the Service.
- Use the Service in any manner that could damage, disable, overburden, or impair its functionality.
- Interfere with or disrupt the experience of other users.
- Use the Service for any commercial purpose, including but not limited to reselling access, creating competing products, or operating tutoring services based on our content.
7. Content Disclaimer
AiMedQs is a study aid designed to help Canadian family medicine residents prepare for the College of Family Physicians of Canada (CFPC) Certification Examination in Family Medicine, specifically the exam preparation. You expressly acknowledge and agree that:
- Not medical advice: The content provided on the Service is for educational and exam preparation purposes only. It does not constitute medical advice, clinical guidance, or a substitute for professional medical education, clinical training, or the judgment of a qualified healthcare professional.
- No affiliation with CFPC: AiMedQs is an independent platform. We are not affiliated with, endorsed by, or officially connected to the College of Family Physicians of Canada (CFPC), any Canadian medical school, or any residency program.
- No guarantee of exam success: Use of the Service does not guarantee any particular outcome on the medical licensing examination or any other certification exam. Exam results depend on many factors beyond the scope of this Service.
- Content accuracy: While we strive to ensure all content is accurate and aligned with current Canadian clinical guidelines, medical knowledge evolves continuously. We do not warrant that all content is complete, current, or error-free at all times.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- AiMedQs, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, or any damages arising from your use of or inability to use the Service.
- Our total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the total amount you paid to AiMedQs in the 12 months immediately preceding the event giving rise to the claim.
- We do not guarantee uninterrupted, timely, secure, or error-free operation of the Service. Scheduled and unscheduled maintenance, system failures, or other factors may cause temporary interruptions.
9. Termination
We reserve the right to suspend or terminate your account and access to the Service, at our sole discretion, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or any applicable law.
- Abuse of the referral program or credit system.
- Sharing account credentials or Service content in violation of Section 6.
- Engaging in activities that harm the Service, other users, or the reputation of AiMedQs.
- Non-payment of subscription fees.
Upon termination for cause, you forfeit all remaining credits and any right to a refund, unless otherwise required by applicable law. If we terminate your account without cause, you will receive a pro-rated refund for the unused portion of your current billing cycle.
10. Refund Policy
We want you to be satisfied with AiMedQs. Our refund policy is as follows:
- First billing cycle: If you are not satisfied with the Service, you may request a pro-rated refund within 7 days of your first paid subscription charge. The refund amount will be calculated based on the unused portion of your billing cycle.
- Subsequent billing cycles: No refunds are available after the first 7 days of your initial subscription or for any subsequent billing cycles.
- Trial period: The free trial does not involve any charge and therefore is not eligible for a refund.
- Termination without cause: If AiMedQs terminates your account without cause, you will receive a pro-rated refund for the remaining days in your current billing cycle.
To request a refund, contact us at [email protected] with your account email and reason for the request. Refunds are processed within 10 business days.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the Province of Ontario, Canada, and you consent to the personal jurisdiction of such courts.
12. Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, the parties agree to the following resolution process:
- Good faith negotiation: The parties shall first attempt to resolve the dispute through good faith negotiation for a period of 30 days following written notice of the dispute.
- Binding arbitration: If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration administered in accordance with the Arbitration Act, 1991 (Ontario). The arbitration shall take place in the Province of Ontario, conducted in English by a single arbitrator. The arbitrator's decision shall be final and binding on both parties.
- Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
13. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AiMedQs regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
